These Terms and Conditions govern your use of noelcrate.com and any purchase you make from it. The site is operated by ELOWEN SKINCARE LLC, a limited liability company registered in the State of Montana, United States ("we", "us", "our"). By placing an order you agree to these terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to buy from this store. By ordering you confirm that you are, and that the billing and shipping information you give us is accurate and belongs to you or to someone who has authorized you to use it.

2. Products and Descriptions

We describe each item using the specification supplied to us by our manufacturing partner. Materials, finishes, stone types, measurements and weights are stated on the product page. We do not hold independent laboratory certification for the metals or stones we sell and we make no certification claim. Screen color rendering varies between devices, and hand-finished elements vary slightly between pieces. Measurements may vary within normal manufacturing tolerance.

3. Orders, Pricing and Contract Formation

All prices are in US dollars. Placing an order is an offer to buy. The contract is formed when we send you a shipping confirmation, not when you receive an order acknowledgment.

We try to price and describe everything accurately, but errors happen. If an item is listed at an incorrect price or with a materially incorrect description, we may cancel the order even after it is acknowledged, and we will refund you in full. We will contact you before doing so.

We may limit or cancel quantities purchased per person, per household or per order, and we may refuse any order.

4. Payment

Payments are processed by Stripe, a third-party payment provider that maintains PCI DSS compliance. We do not receive or store your full card number. Transactions are transmitted over HTTPS with TLS encryption. Further detail is in our Payment Policy.

5. Shipping, Duties and Delivery

Orders ship from our manufacturing partner's warehouse in China to addresses in the 48 contiguous United States and the District of Columbia. Import duties are included in the price and settled by us; you owe nothing on delivery. Sales tax, where applicable, is calculated at checkout. Delivery timeframes are estimates, not guarantees. 6. Returns and Cancellation

Returns are accepted within 30 days of delivery under the conditions set out in our Refund & Returns Policy, which forms part of these terms. Orders may be cancelled within 24 hours of being placed provided they have not shipped.

7. Customer Reviews and Testimonials

We do not publish fake, incentivized or purchased reviews, and we do not suppress negative reviews to manipulate an average rating. We do not currently display reviews on this store. If and when we do, they will be genuine reviews from verified buyers, and any material connection between a reviewer and this business will be disclosed. This reflects our obligations under the Federal Trade Commission's Rule on the Use of Consumer Reviews and Testimonials.

8. Intellectual Property

The noelcrate name, site design, page copy and product photography as presented on this site are owned by or licensed to us. You may not copy, reproduce or republish them for commercial purposes without written permission. Product names that refer to materials, cuts, closures or styles are descriptive terms and are not claims of affiliation with any brand.

Copyright Complaints

If you believe material on this site infringes your copyright, email support@noelcrate.com with the subject line "DMCA Notice" and include: identification of the work, identification of the material and its location on our site, your contact details, a statement of good-faith belief that the use is unauthorized, a statement that the information is accurate and that you are authorized to act, and your physical or electronic signature. We will investigate and remove infringing material where the complaint is substantiated.

9. Acceptable Use

You agree not to use the site to transmit malicious code, to attempt unauthorized access to any part of the site or its systems, to scrape content at a scale that burdens the service, or to place fraudulent orders.

10. Disclaimers and Limitation of Liability

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

11. Governing Law and Disputes

These terms are governed by the laws of the State of Montana, United States, without regard to its conflict of law rules.

Nothing in this section prevents you from bringing a claim in the courts of the state where you live, or from bringing a claim in a small claims court in your own jurisdiction. Your rights as a consumer are not affected by this section, and nothing here limits the authority of the Federal Trade Commission or your state Attorney General to act on your behalf.

12. Changes to These Terms

We may update these terms. The effective date at the top shows when the current version took effect. The terms that apply to your order are the ones in force on the day you placed it.
